Official confirmation: Free modem choice in the Netherlands is a success story for Europe. And in Italy? AGCOM’s decision is still pending.
25 July 2025 – VTKE (Alliance of Telecommunications Terminal Equipment Manufacturers) welcomes the assessment by the Dutch authority ACM, which concludes that the regulation on free modem choice – in force for over three years in the Netherlands – is working well and does not require any changes.
The regulation, which also defines the so-called “network termination point,” is considered “fit for purpose in promoting the free choice of terminal equipment.” This outcome confirms that the model works effectively in practice.
The evaluation is based on Article 10 of the national directive on terminal equipment, which mandates a regulatory impact review at least two years after implementation.
Thanks to this approach, the decision over which device to connect to the network – whether via fiber, cable, or DSL – lies entirely with the customer.
The benefits for users are clear:

- Savings and flexibility: No rental fees and easier switching between providers.
- Increased competition and innovation: Free choice stimulates the market and drives technological advancement.
- Sustainability: Devices can be used longer, reducing electronic waste.
- Better security and data protection: Users retain full control over settings, updates, and data privacy.
Across Europe, the right to free modem choice has been recognized since 2015. However, without clear regulation defining the network termination point within households (the so-called “Point A”), this right remains theoretical.
VTKE sees the Netherlands as a European frontrunner. Now that ACM has confirmed the success of free modem choice, the Alliance calls on AGCOM to follow the Dutch example – and that of other European countries – by adopting a transparent, competitive, and future-oriented model for Italy’s digital infrastructure.
